What is Advance Parole?

Advance Parole is a document for the applicants of Adjustment of Status to travel outside the United States; otherwise their Adjustment of Status applications may deem abandoned if they travel outside the United States.

Who should apply for Advance Parole?

Applicants who are in the process of their Adjustment of Status should apply for Advance Parole if they plan to travel outside the United States before their permanent residency (green card) is approved.

Who should not apply for Advance Parole?

People who are subject to 3/10 year bar because of unlawful presence should not apply for Adnance Parole. They will still be subject to the 3/10 year bar when they intend to return to the US even if they are granted Advance Parole.

Who do not need to (but can still choose to) apply for Advance Parole?

• Valid H-1B, L-1A and L-1B holders and their dependent family members (H-4 and L-2) who are not under exclusion, deportation and removal proceedings may travel outside of US without Advance Parole.

• Valid K-3 and K-4 holders who are not under exclusion, deportation and removal proceedings may travel outside of US without Advance Parole.

When to apply for Advance Parole?

The application of Advance Parole must be filed and approved before the applicant departs the United States.

How to apply for Advance Parole?

The Reentry Permit application should be filed using form I-131 with the US Citizenship and Immigration Services (USCIS).
